TV Free Media, LLC dba Spiro100 (“Spiro100”) is a Leisure Care LLC Third-Party Provider that offers health, fitness, and wellness information and related products, services, content, and features (collectively the “Spiro100 Content”) via the Leisure Care App. By accessing or using the Spiro100 Content You expressly agree to the following terms:
Spiro100 Content offers health and fitness information and is designed for educational and entertainment purposes only, nothing stated in the Spiro100 Content constitutes the practice of medicine or counseling care, nor is medical or healthcare advice. You acknowledge that physical exercise in all forms that may be shown in the Spiro100 Content may constitute strenuous physical exercise and poses the risk of injury and/or physical or mental exhaustion. You expressly agree to obtain physician authorization before using the Spiro100 Content. You agree that the use of the Spiro100 Content is solely at Your own risk. You further agree that it is Your responsibility to judge Your physical and mental capabilities, and that it is Your responsibility to ensure that by participating in classes, videos, and/or activities from Spiro100, You will not exceed your limits in the practice of physical exercise and/or movement, and You will select the appropriate level of classes for Your skills and abilities, as well as for any mental or physical conditions and/or limitations You have.
By electing to utilize Spiro100 Content, You expressly acknowledge that Your use of any Spiro100 Content may lead to personal and/or bodily injury, death, loss of services, loss of consortium, or damage to or loss of property or privacy. You expressly assume any and all liability that may arise from Your use of the Spiro100 Content, and You agree that Your use of Spiro100 Content shall be at Your sole risk. You hereby acknowledge and willingly accept these risks and agree to unconditionally release and hold harmless Spiro100 and Leisure Care from and against all claims, suits, causes of action, costs, expenses or liability arising out of or related to your access, use and/or involvement with the Spiro100 Content. You further expressly waive and release any and all claims, damages, liabilities, costs, and/or expenses, including court costs and reasonable attorneys’ fees that You (and/or Your representative(s), estate, family member(s), or other person(s), asserting a claim of injury and/or damage from Your use of the Spiro100 Content) may have at any time, for injury of any kind against Spiro100 and/or Leisure Care. You further agree to indemnify, defend and hold harmless Spiro100 and Leisure Care from and against all claims, damages, losses and costs brought by a third party that arise from or relate to Your use of the Spiro100 Content or violation of these terms.
Website/Online User Privacy Policy
This Website/Online User Privacy Policy (“Policy”) governs the manner in which Leisure Care LLC, a Washington limited liability company, and the retirement communities it manages (“Leisure Care”) collects, uses, maintains and discloses information collected from you or other users (each, a "User") of the http://www.leisurecare.com, http://www.oneeightytwist.com, http://mackenzieplace.com, http://heritageestatesretirement.com, http://www.betreeo.com, http://mackenzieplacethelodge.com/, and/or http://www.thecarillonatbouldercreek.com websites (individually and/or collectively "Site(s)"). This Policy applies to the Site(s) and all products and services offered by Leisure Care through such Site(s).
Personal Indentification Information
Leisure Care may collect personal identification information obtained from Users in a variety of ways, including, but not limited to, when Users visit the Site(s), fill out a form on such Site(s), and/or in connection with other activities, services, features or resources Leisure Care makes available on the Site(s). Users may be asked for, as appropriate, name, email address, mailing address, and phone number, and are giving permission for Leisure Care to contact them when this information is provided. Users may, however, visit the Site(s) anonymously. Leisure Care will collect personal identification information from Users only if they voluntarily submit such information. Users can always refuse to supply personal identification information, except that it may prevent Users from engaging in certain related activities to the Site(s). At this time Leisure Care does not have a process by which User can review and/or request changes to User’s personally identifiable information collected by Leisure Care.
Non-personal Indentification Information
Leisure Care may also collect non-personal identification information about Users whenever they interact with the Site(s). Non-personal identification information may include the browser name, the type of computer and technical information about User’s means of connection to the Site(s), such as the operating system and the Internet service provider utilized and other similar information.

How Leisure Care Protects User's Information
Leisure Care has adopted appropriate data collection, storage, and processing practices and security measures designed to protect against unauthorized access, alteration, disclosure or destruction of User’s personal information, username, password, transaction information and data stored on the Site(s).
Sharing User Personal Information
Leisure Care does not sell, trade, or rent User’s personal identification information to others. Leisure Care may share generic aggregated demographic information not linked to any personal identification information regarding visitors and Users with its business partners, trusted affiliates and advertisers for the purposes outlined above
Changes to this Policy
Leisure Care has the discretion to update and/or change this Policy at any time and for any reason. When it does, Leisure Care will post a notification on the main page of its Site(s) and revise the updated/effective date at the bottom of this page. Leisure Care encourages Users to frequently check this page for any changes to stay informed about how Leisure Care is helping to protect the personal information collected. User acknowledges and agrees that it is User’s responsibility to review this Policy periodically and become aware of any and all modifications, changes, and/or amendments.
User Acceptance of these Terms
